Financial Liability Agreement
PROMISE TO PAY
By registering for any course(s) at UF, or by receiving any educational service(s) from UF, I accept full responsibility to pay all debts, charges, fees, and other associated costs assessed as a result of my registration and/or receipt of service. I further understand and agree that my registration and acceptance of these terms constitutes a promissory note agreement (i.e., a financial obligation in the form of an educational loan as defined by the U.S. Bankruptcy Code at 11 U.S.C. § 523(a)(8)) in which UF is extending credit to me by providing educational services while deferring some or all of my financial obligation(s) for those services. I understand and agree that this extension of credit to me permits me to attend classes at UF in return for a payment of tuition at a future date. I promise to pay for all debts, charges, fees, and other associated costs by the published or assigned due date.
I understand and agree that I will be held liable for all charges and fees related to course(s) that are on my schedule.
DELINQUENT ACCOUNT
Financial Hold: I understand and agree that if I fail to pay my student account or any monies due to UF by the scheduled due date, UF will place a financial hold on my account that will result in university registration and services being withheld in accordance with university regulations. These actions include, but are not limited to, preventing me from registering for future classes; withholding my transcripts; and withholding my diploma.
Late Payment Fee: I understand and agree that if I fail to pay all of my tuition and fees by the scheduled due date, I will be subject to a $100.00 late payment fee.
Collection Agency Fees: I understand and accept that if I fail to pay my student account or any monies due to UF by the scheduled due date, UF may refer my account to a collection agency. I further understand and agree to pay all costs of collecting unpaid charges, including a percentage based third-party collection fee up to 30%, reasonable attorney’s fees, and court costs the university may incur in efforts of collecting my account. Finally, I understand that my delinquent account may be reported to one or more credit bureaus.
RETURNED PAYMENTS
Check/ACH: If a check/ACH payment made to my student account is returned by the bank for any reason, I agree to repay the original amount of the payment plus a returned payment fee that is structured as follows:
- A minimum service charge of $25.00
- A service charge of $30.00 if the returned payment is greater than $50.00 but less than $300.00
- A service charge of $40.00 if the returned payment is greater than $300.00
I understand that multiple returned payments may result in cancellation of my classes, suspension of my eligibility to register for future classes, and suspension of my ability to pay via check and/or ACH.
Credit Card: I understand and agree that if any credit card payment on my account is returned for a disputed transaction, I will be responsible for the original amount of the payment and may have my ability to make future credit card payments revoked.
Furthermore, I understand and agree that credit card payment transaction fees are non-refundable under any circumstance.
WITHDRAWAL
I understand that many unexpected events may cause me to decide to withdraw from UF or to alter my enrollment. I also understand that withdrawing from UF or dropping one or more courses may have important consequences, both educational and financial. If I withdraw prior to completing 60 percent of the term, I may be required to repay a substantial portion of any federal financial aid I received. STUDENT AGE
I understand and agree that § 743.05, Fla. Stat., which removes the disability of nonage for students 16 year or older for the purpose of borrowing money for higher educational expenses, applies to this agreement. I further understand and agree that the educational services provided by UF are a necessity, and I therefore waive any defense to this agreement based on my age, including but not limited to the defenses of infancy, disability of nonage, or disability of minority.
COMMUNICATION
Electronic Communication: I understand and agree that UF uses my official university e-mail address as an official method of communication with me. I further acknowledge that it is my responsibility to view my charges in ONE.UF or at the location designated by my academic program.
Updating Contact Information: I understand and agree that updating my contact information is my responsibility. Contact Information includes, but is not limited to, the following: current physical addresses, email addresses, and phone numbers. These items can be updated at: https://one.uf.edu/directoryprofile/
Contact: I understand and authorize UF and its agents and contractors to contact me regarding my loan(s), student account, and/or any monies owed to UF at the current or any future number for my cellular phone or other wireless device, either provided or acquired, in any manner chosen by UF, including using automated telephone dialing equipment or artificial or pre-recorded voice or text messages.
1098-T: I consent to receive my IRS tax form 1098-T electronically, now and in subsequent years, via online access in ONE.UF in lieu of a mailed copy. If I desire to receive a mailed copy, I must revoke my consent by completing and submitting a signed and dated original IRS 1098-T Tuition Statement Paper Request Form to the Bursar.
REFUNDS
The University Bursar’s Office will provide timely refunds of overpayments on student accounts. I understand that it is my responsibility to provide accurate information for the refund to process by direct deposit or check mailed to the current address on file. Overpayments from credit card payments will be refunded to the card of origin for the transaction which has overpaid the account. If refunding to the card of origin is not feasible (the card account is closed; the refund date is more than one year later than the date of the original transaction; or the refund is rejected by the bank/credit card company) the refund will be submitted to the direct deposit on file or a check will be mailed to the current address on file.
Unclaimed refunds $10.00 and greater with no activity for two years will be escheated to the State of Florida Office of the Chief Financial Officer. These funds can be retrieved from the state by contacting the Florida Department of Financial Services, Division of Unclaimed Property. Unclaimed refunds less than $10.00 may be retained by the University.
MISCELLANEOUS
Exit Counseling Requirement: I understand that if I receive student loan(s) and/or Federal TEACH grants while attending UF I must complete an Exit Counseling session(s) when I graduate, leave school, or drop below half-time enrollment. This counseling is designed to assist students with understanding their rights and responsibilities regarding their student loan(s) and/or Federal TEACH grant awards. I understand that until the Exit Counseling requirement is satisfied, a hold will be placed on my UF student account preventing the receipt of academic transcripts, diploma, and other university services. After Exit Counseling has been completed, the exit counseling hold will be removed from my student record within 48 hours.
Cancelation: I understand that if I do not pay any amount of my course tuition and fees, or they are not deferred by the published deadline, I may be withdrawn with fee liability from all courses. If I am withdrawn, I will no longer be eligible to attend and participate in classes or other university activities. I also will not be able to register for any future term until my outstanding debt is satisfied.
I understand and acknowledge that this agreement is delivered in Alachua County, Florida, and is governed by Florida law. I acknowledge that any lawsuit to collect unpaid debt(s) may be brought in the appropriate court sitting in Alachua County, Florida, regardless of my domicile at the time of bringing such suit.
